Insurance for Rental Property – Tailoring It to the Tenant

Always obtain the proper insurance for your property. A property owner leased a house to a tenant on a yearly basis. The tenant made a claim against the owner for issues regarding mold. The owner put his insurance company on notice of the claim and requested his insurance company to defend him. The insurance company sued the owner asking for the court to find that the insurance company did not have an obligation to defend the owner because of a policy exclusion. The exclusion excluded claims from annual tenants and only protected the owner from claims of casual tenants. The court found that the insurance company had no obligation to defend the owner from the annual tenant’s claim. The lesson learned is that if you are going to rent your property, make sure your insurance agent sells you a policy that covers the type of tenants which are leasing your property. Falzone v. Florida Residential Property and Casualty Joint Underwriting Association, 925 So.2d 398 (Fla. 4th DCA 2006).
