The Alternative Dispute Resolution (“ADR”) section of Englander Fischer helps counsel and clients achieve confidential, economical, and practical solutions to problems. The majority of business disputes are eventually resolved outside of the courtroom. The ADR team understands that a settlement which the parties and their lawyers have created is often more beneficial and meaningful than that crafted by judge or jury.
Englander Fischer’s ADR team offers mediation services in business disputes throughout the State of Florida. Leonard S. Englander is certified by the Florida Supreme Court as a Circuit Civil Mediator, and has years of experience in providing sensible, realistic solutions to client problems. In addition to serving as a mediator, Leonard also serves as a Settlement Counsel, retained for the sole purpose of devising and implementing settlements in difficult disputes. For example, when non-firm lawyers and their clients are unable to effectively communicate with opposing counsel.
The mediation process is unique. Opposing parties and their counsel meet, either voluntarily or under court order, under the auspices of a mediator whose sole function is to help them find a solution to their dispute. At times the parties perceive their case cannot be settled and they are merely going through a mandatory formality, greeting the mediator’s initial efforts with skepticism. But as time goes on and the parties have an opportunity to interact openly under the protection of confidentiality and privilege, they realize that they can craft a solution that very day that ends the financial burden, delays, and emotional distress which accompany litigation.
